This Privacy Policy explains how Montivory Co., Ltd. ("Company," "we," "us," or "our") collects, uses, discloses, and protects personal data of users ("you" or "your") in connection with Mind, our social listening and trend monitoring platform ("Service").
We process your personal data in accordance with the Personal Data Protection Act B.E. 2562 (PDPA) of Thailand and other applicable laws. By registering for, accessing, or using Mind, you acknowledge that you have read and understood this Privacy Policy.
This Privacy Policy forms part of, and should be read together with, our Terms and Conditions.

4. How We Use Your Personal Data

We process your data as necessary to provide Mind, including to:

Provide dashboards, AI-generated summaries, sentiment analysis, share of voice, and other analytics features

Process Mind Pro subscriptions and payments via Omise (when available)

Send you service-related notifications you have enabled (e.g., Daily Trend digests, Sentiment Alerts, AI Highlight Summaries, New Top Keywords alerts)

4.2 To Maintain Security and Prevent Misuse
We process certain data to protect the Service, our users, and our business, including to:

Mind uses cookies and similar technologies to enable core functionality and improve your experience, including:

We use Google Analytics, a web analytics service provided by Google LLC, which uses cookies to collect aggregated information about how users interact with Mind. This data is used to analyze usage patterns and improve the Service. Google may process this data on servers located outside Thailand. For more information, see Google's Privacy Policy.
You may opt out of Google Analytics tracking at any time using the Google Analytics Opt-out Browser Add-on.
We do not currently use marketing cookies or tracking pixels. If this changes in the future, we will update this Policy and seek your consent where required by law.
6. How We Share Your Personal Data
We do not sell your personal data. We may share your data with the following recipients, only as necessary and subject to appropriate safeguards:

- In connection with a merger, acquisition, restructuring, or sale of assets, your personal data may be transferred to the relevant third party, subject to confidentiality obligations and continuity of data protection.
We do not provide your personal data to third parties for their own independent marketing purposes without your explicit consent.
7. International Transfers
Our cloud infrastructure and email services are hosted on Microsoft Azure, which may process and store data on servers located outside Thailand, including in the Asia Pacific region (Singapore, Hong Kong, and Japan). We use Google Analytics (Google LLC, United States) to process aggregated usage data. In all cases, we ensure cross-border transfers comply with PDPA requirements through data processing agreements and standard contractual clauses that provide an adequate level of protection for your personal data.

Where we no longer need personal data, we will securely delete or anonymize it.
9. Your Rights Under PDPA
Subject to conditions and exceptions under PDPA, you have the following rights:

You also have the right to lodge a complaint with the Personal Data Protection Committee (PDPC) if you believe your rights have been violated.
10. Security Measures
We implement appropriate technical and organizational measures to protect your personal data, including:

11. Age Requirement
Mind is intended for users who are 18 years of age or older. By registering, you confirm that you meet this requirement. We do not knowingly collect personal data from users under 18. If we become aware of such an account, we will delete it promptly. To report an underage registration, contact support.mind@montivory.com.
12. Third-Party Websites and Services
Mind may contain links to third-party websites or services, including Google and Facebook for OAuth login. We are not responsible for the privacy practices, content, or security of those third parties. We encourage you to review their privacy policies before using their services.
13. Changes to This Privacy Policy
We may update this Privacy Policy to reflect changes in our practices, technologies, legal requirements, or service offerings such as the launch of Mind Pro. When we make material changes, we will notify you by posting the updated Policy on our website or within the app, and/or sending a notice to your registered email address. Your continued use of Mind after the updated Policy takes effect constitutes your acceptance of the changes.
