1. Introduction

This Privacy Policy explains how Montivory Co., Ltd. ("Company," "we," "us," or "our") collects, uses, discloses, and protects personal data of users ("you" or "your") in connection with Mind, our social listening and trend monitoring platform ("Service").

We process your personal data in accordance with the Personal Data Protection Act B.E. 2562 (PDPA) of Thailand and other applicable laws. By registering for, accessing, or using Mind, you acknowledge that you have read and understood this Privacy Policy.

This Privacy Policy forms part of, and should be read together with, our Terms and Conditions.

3. Personal Data We Collect

3.1 Account Information (Email Registration)

  • Name and surname

  • Email address

  • Password (stored in encrypted form; we never store plaintext passwords)

3.2 Account Information (Google or Facebook Login)

When you sign in using Google or Facebook (OAuth), we receive and store:

  • Name

  • Email address

  • Profile photo

We do not receive or store your Google or Facebook password. Your use of those login methods is also subject to Google's and Facebook's respective privacy policies.

3.3 Profile and Preference Information

  • Interests and selected categories

  • Topics and keywords you create or follow

  • Notification preferences

3.4 Usage and Technical Data

  • Log data (date/time of access, pages viewed, features used)

  • IP address, device identifiers, browser type, operating system

  • In-app actions (e.g., topics created, time ranges adjusted, dashboards viewed)

3.5 Analytics Data

We use Google Analytics to collect aggregated, anonymized data about how users interact with Mind, including pages visited, features used, and session duration. This data is used solely to improve the Service and is not used to identify you individually.

3.6 Subscription and Billing Data (Mind Pro --- coming soon)

  • Plan type and billing history

  • Limited payment information (e.g., last 4 digits, card brand) as provided by Omise

  • We do not store full card numbers or CVV codes

3.7 Communication Data

  • Emails or messages you send to our support team

  • Feedback or survey responses

Sensitive personal data: We do not intentionally collect sensitive personal data through Mind. If you input such data into topics or keywords, you do so at your own risk and we may remove such content where appropriate.

4. How We Use Your Personal Data

4.1 To Provide and Operate the Service

We process your data as necessary to provide Mind, including to:

  • Create and manage your user account

  • Authenticate your login (including via Google or Facebook OAuth) and maintain your session

  • Provide dashboards, AI-generated summaries, sentiment analysis, share of voice, and other analytics features

  • Process Mind Pro subscriptions and payments via Omise (when available)

  • Send you service-related notifications you have enabled (e.g., Daily Trend digests, Sentiment Alerts, AI Highlight Summaries, New Top Keywords alerts)

  • Notify you of service changes, outages, or security issues

4.2 To Maintain Security and Prevent Misuse

We process certain data to protect the Service, our users, and our business, including to:

  • Monitor and prevent fraud, abuse, or unauthorized access

  • Detect and respond to security incidents or technical issues

  • Enforce our Terms and Conditions and Acceptable Use Policy

4.3 To Improve Mind and Develop New Features

We may use aggregated and pseudonymized usage data to:

  • Analyze how features are used and identify usability issues

  • Develop new features and improve existing ones

  • Improve AI models and analytics performance (without directly targeting individuals)

Where possible, we use aggregated or anonymized data so that individuals cannot be re-identified.

4.4 To Communicate with You About the Service

We use your contact information to:

  • Send service announcements, security alerts, and administrative messages

  • Respond to your support requests and inquiries

4.5 Marketing Communications

Where you have given us your consent, we may use your name and email address to send you marketing communications from Mind, including product updates, promotions, and event invitations.

We will only send marketing communications to users who have opted in. You may withdraw your consent at any time by clicking the unsubscribe link in any marketing email, or by contacting us at support.mind@montivory.com

5. Cookies and Similar Technologies

Mind uses cookies and similar technologies to enable core functionality and improve your experience, including:

  • Authentication, session management, and remembering your login state

  • Analytics to understand how the Service is used and to improve its performance

We use Google Analytics, a web analytics service provided by Google LLC, which uses cookies to collect aggregated information about how users interact with Mind. This data is used to analyze usage patterns and improve the Service. Google may process this data on servers located outside Thailand. For more information, see Google's Privacy Policy.

You may opt out of Google Analytics tracking at any time using the Google Analytics Opt-out Browser Add-on.

We do not currently use marketing cookies or tracking pixels. If this changes in the future, we will update this Policy and seek your consent where required by law.

6. How We Share Your Personal Data

We do not sell your personal data. We may share your data with the following recipients, only as necessary and subject to appropriate safeguards:

Professional Advisors

  • Lawyers, auditors, or consultants, where necessary for legal, compliance, or business purposes.

Authorities and Legal Requests

  • Government authorities, regulators, or courts where required by Thai law, court order, or to protect our legal rights.

Business Transfers

  • In connection with a merger, acquisition, restructuring, or sale of assets, your personal data may be transferred to the relevant third party, subject to confidentiality obligations and continuity of data protection.

We do not provide your personal data to third parties for their own independent marketing purposes without your explicit consent.

7. International Transfers

Our cloud infrastructure and email services are hosted on Microsoft Azure, which may process and store data on servers located outside Thailand, including in the Asia Pacific region (Singapore, Hong Kong, and Japan). We use Google Analytics (Google LLC, United States) to process aggregated usage data. In all cases, we ensure cross-border transfers comply with PDPA requirements through data processing agreements and standard contractual clauses that provide an adequate level of protection for your personal data.

Where we no longer need personal data, we will securely delete or anonymize it.

9. Your Rights Under PDPA

Subject to conditions and exceptions under PDPA, you have the following rights:

  • Right to Access. Request confirmation of whether we process your data and obtain a copy

  • Right to Rectification. Request correction of inaccurate or incomplete data

  • Right to Erasure. Request deletion where data is no longer necessary or consent has been withdrawn

  • Right to Restriction. Request that we limit processing in certain circumstances

  • Right to Data Portability. Where technically feasible, receive your data in a structured, machine-readable format

  • Right to Object. Object to processing for analytics or direct marketing purposes

  • Right to Withdraw Consent. Withdraw marketing consent at any time without affecting prior lawful processing

To exercise any of these rights, contact us at support.mind@montivory.com. We may need to verify your identity before responding.

You also have the right to lodge a complaint with the Personal Data Protection Committee (PDPC) if you believe your rights have been violated.

10. Security Measures

We implement appropriate technical and organizational measures to protect your personal data, including:

  • Encryption of data in transit (TLS) and at rest

  • Access controls and role-based permissions

  • Microsoft Azure infrastructure security and regular security updates

  • Internal policies and staff awareness on data protection

No method of transmission or storage is completely secure. While we take reasonable steps to protect your data, we cannot guarantee absolute security.

11. Age Requirement

Mind is intended for users who are 18 years of age or older. By registering, you confirm that you meet this requirement. We do not knowingly collect personal data from users under 18. If we become aware of such an account, we will delete it promptly. To report an underage registration, contact support.mind@montivory.com.

12. Third-Party Websites and Services

Mind may contain links to third-party websites or services, including Google and Facebook for OAuth login. We are not responsible for the privacy practices, content, or security of those third parties. We encourage you to review their privacy policies before using their services.

13. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in our practices, technologies, legal requirements, or service offerings such as the launch of Mind Pro. When we make material changes, we will notify you by posting the updated Policy on our website or within the app, and/or sending a notice to your registered email address. Your continued use of Mind after the updated Policy takes effect constitutes your acceptance of the changes.
